Feeling ********** & Cheated (Re/Max Allstars Alberton)

Remax Allstars Alberton has pathetic client service, we are approaching the 3rd month of vacating a rented unit in Jhb south, and still have not received our rental deposit back. Terrance the agent confirmed after inspection (which no damages were found) the deposit would be refunded after deducting the previous month's water and electricity bill. Terrance has not reverted back to us instead directed us to deal with the owner of the unit (of which we had no dealing with, this is the reason we used a "reputable" agency - so we thought) after the deposit was paid to Re/max and later into the lease Terrance had confirmed that the deposit will be refunded by the attorney's who facilitated the sale of the unit before settling the owner the balance., we escalated the case to the broker owner (Jenny De Necker) absolutely no feedback as well, further escalated the case to Re/max client services on the 31 May 2021, absolutely no response (after been informed the turn around time for resolution or feedback is 48hours). This is just a summary - very short version of the events that transpired since we engaged with Re/max on this rental agreement. If there is anybody that cares to assist from Re/max, please contact the author of this review, failure to do so, will leave me with no option, but to pursue our next step which is for me to take this to social media as well as the legal route, as I have all correspondence between myself and the Re/max Allstar representatives.

Please note that I have still not recieved any joy in the conclusion of this matter. Remax is still going on about the owner has the deposit whereas I have deposited this into remax's account and in the lease agreement under 13.4 it states " If the deposit is paid to the agent and not to the landlord, the agent will invest the deposit in accordance with the provisions of the EAAA" THIS DEPOSIT WAS TRANSFERRED INTO REMAX's ACCOUNT, and they transferred it without my knowledge or permission to the owner. I was only informed VERBALLY at a latter stage.

Remax this issue needs to be sorted I vacated the premises on the 24th of April. I WANT MY MONEY! WHATEVER ARRANGEMENT YOU GUYS HAD WITH THE OWNER IS NOT MY PROBLEM!

Good day, please note that this process that Remax All Stars is following is becoming tiring and im having absolutely no satisfaction.

Jenny has responded the below:
"Good day Sherry-Ann
Your e-mail has been noted.
Please refer to my e-mail sent on the 22nd of June 2021 (attached for ease of reference), as we are going round and round the same circle.
As you are aware, we had a meeting with the landlord and he indicated that he would pay the deposit. You are welcome to contact Mr Rankoko, as the lease agreement was between yourself and Mr Rankoko. We are only intervening to assist you.
As mentioned the attorneys have contacted Mr Rankoko to make payment soonest. You are also welcome to phone Angela from NGL Attorneys, as she is dealing with the matter herself.
We are doing everything we can to get the landlord to pay your deposit."

I find this unacceptable because according to the contract that I signed, if the deposit was transferred to the estate agent the deposit WILL BE KEPT BY THEM IN AN INTEREST BEARING ACCOUNT! AS PER 13.4 on the lease agreement! I transfered the deposit to Remax All Stars and still have the proof! I'm tired of hearing about the owner that needs to refund my deposit, I did not transfer the deposit to the owner Remax did without my permission, and only after I had moved in I was notified that they transferred it to the owner.

I'm tired of being pushed from pillar to post!

I do not see why I have to fight for MY MONEY!

Please note I am now receiving letters from lawyers telling me that Remax has only initiated this lease?????

As per the lease agreement 13.4 it is stated that:

"If the deposit is paid to the Agent and not to the Landlord, the Agent will invest the Deposit in accordance with the provisions of the EAAA"

This deposit was paid to remax, and I did not give Remax any permission whatsoever to transfer this deposit to the Landlord, I was only later notified that the deposit was transferred to the Landlord after taking occupation.

REMAX is pathetic, and I will now be consulting with my own lawyer to resolve this issue because clearly you as Remax is not capable of doing it yourselves.
