Dealer refuse to pay back my money

I bought a car from this dealer at 85Main road,Amalinda,EL We paid R103 000.00 he failed to deliver the car after 2weeks he admitted that the condition of the car is very bad,he won't be able to deliver.When he refunded us he only deposited R100,0pp.00 and claims that R3000 will be cancellation fee,although we never had such an agreement and the breach was due his failure to fulfill his obligations Until to date he refuses to pay us back the outstanding R3000,the dealer is in the main road next to Sasol garage ,85 main street Amalinda,Director:Milasoma Kumar who is refusing to refund us in full
