Lack of communication

Good day.

I am seeking assistance with regards to Proximity Property.

We are struggling to get assistance from them with regards to the complex that we are living in. I did not want to follow this route but we are left with no choice.

In the month of January 2016, the motor vehicle got damaged by the garden service who was mowing the lawn irresponsibly. The front bumper and windscreen was damaged. We reported it to Proximity. They told us to contact the garden service directly. Which we tried on numerous occasions but received no reply from them. It's been a struggle for months. Months later after endless communication with proximity, the lady of the garden service pitched up at our door with another white gentleman and the two gardeners(when I was alone at home and my boyfriend was gone to work that morning). She came to argue with me. I previously warned her if there was any damage to the property, they will be liable. Now she is denying that the vehicle was damaged by them and said that we are lying. The gardener also damaged the garden lights last month. She later came to take pictures of the property. I asked her why is she taking pictures of our property, she said that she will need them for court because I told her that we will take the matter further. I asked her if it was fair that they keep damaging our property and showed her the garden light. She took it and said that she will replace it(if you know that you are not guilty, why will you replace someone's property). It's almost a month since she took the light and she has not replaced the light or brought the damaged light back. I then communicated to Proximity and they say that it's not their vehicle and we must sort the matter out ourselves. They also told us that there are indemnity boards to say that they are not liable for any damages. WE ARE NOT CLAIMING FROM PROXIMITY PROPERTY, WE ARE ASKING THEM TO SORT OUT THE MATTER. In the rules and regulations of the complex, it says(COMPLAINTS: any owner or occupier who has a complaint about any member of staff is to report it to the trustees or caretaker, and is not to reprimand any member of staff in person in anyway). We pay levies to the property management agency for handling the matters in the complex but Proximity refuses to assist. We just need them to sort out the matter with the garden service because they have hired the garden service, they are paying the garden service through the levies that the home owners are paying and they have signed the contract and have a contractual agreement with the garden service(it's not the individual home owners who are dealing directly with the garden service). I was initial communicating with Marianne but now she denies telephonically that she spoke to me with regards to this matter(I have proof of the emails that I've communicated the matter to her).

I've sent Rachel at Proximity numerous email, but she only replies to certain emails. There are matters that I'm unsatisfied with regarding the complex. I've sent her a list of Matters regarding the complex but she did not reply to my emails. After emailing her a few times, she chooses which topics that she wants to give answers on. This happened in a time frame of almost two weeks. There is no transparency on Proximity's side. On the 1st November 2016, Rachel said that she is compiling the information for us. 7th November 2016, I asked her which date can we expect the information that she is compiling? Friday 11th November 2016, I sent her an email saying it's almost two weeks since you've said that you are compiling the information for us. I am expecting the compilation on Monday. This morning I've again emailed her asking as per my email last week, are you done compiling the information for us? We are not receiving any cooperation from Proximity Property.

We also asked for the municipality statements but Rachel said that they can't send out documents to owners via email. But how is it that they've sent us the municipality statement for the month of September 2016?

We were on prepaid water until the beginning of October 2016 but we get billed for the month of September for municipality water. R100 water(6000litres) lasts for over 2 months. But they claim that our water usage was R194.88 and they charged us R150.00 for September.

The prepaid water meters were removed from all the units because they went faulty. They said that they will refund the balance of litres remaining on the meters but we did not receive the credit.

The water meter was removed from the property but they do not speak about the refund for the meter. We have the invoice regarding the purchase of the meter. It's almost two months but there is no communication about the refund.

We expect Proximity Property to be in communication with us, the home owners at all times. We need answers please.

Kind regards.

Sarisha.
********** 127
