FAILURE TO RETURN DEPOSITS TO EX-TENANTS. (Excuse on excuse!).

<p>I was a tenant, renting a unit at 247 Main Reef Road (Industrial Park) Denver, JHB. These premises were sold and taken over by the new owner in Feb 2016 and "managed" by PROPERTUITY. A one on one on site meeting was called on Thursday 29 Sept. 2016 at 14:00. Present at this meeting, representing PROPERTUITY were Neil (designation unknown), Trent ( building manager) and Kelvin (assistant building manager?). Neil was the spokesperson. He informed me that due to the new ownership all previous contracts, agreements etc. were no longer valid. A new contract was proposed with acompanying calculations regarding new tariffs. I was given 7 days to either accept or reject the new contract, if accepted Dec's rent would be waivered. On Fri. 7 Oct 2016 I contacted Trent via phone and informed him that I rejected the new contract and gave him my reasons. I also gave him notice that I would be vacating my unit (R3) on 31 Oct 2016. I was fully paid up to and including 31 Oct. I vacated my unit by Mon.31 Oct. and the unit was inspected by Kelvin on 31 Oct. and was found to be "all correct". All relevant "exit" documentation was completed by Kelvin and signed by myself. This included a form with my banking details for the refund of my deposit (R3000.00). Kelvin stated that I should allow 3 weeks for my deposit to be refunded. I checked my bank account on Tues. 29 Nov. and found that no deposit refund had been received. I contacted Kelvin and he informed me that there were additional forms that I needed to complete at PROPERTUITY's office. On Wed. 30 Nov. I contacted PROPERTUITY's office and spoke to Kerusha ( Credit Controller) who informed me that I had to complete a "Deposit Refund Form". This form was sent to me via email which I completed and returned to Kerusha at 20:44 on 30 Nov. She acknowledged receiving the completed form on Thur. 1 Dec. and stated she would forward it to "Trent" to assist with the refund. She also stated that she would (do my best to push for your deposit refund tomorrow"Fri, 2 Dec. I again checked my bank account on Mon. 5 Dec. and still NO DEPOSIT! On Fri.9 Dec at 13:45 I received a threatening email from "KERUSHA" stating that MY DEC. RENT IS IN ARREARS!! What does NOTICE/VACATE/ NO LONGER RENTING she not understand? Failure to adhere to the above would result in a R570.00 PENALTY FEE! I VACATED THE UNIT ON 31 OCT.2016! I responded to this email asking if this was a sick joke and her response was that "I WAS NOT MADE AWARE THAT YOU WERE VACATED AND AWAITING YOUR DEPOSIT". Where is all the COMPLETED DOCUMENTATION?? This is after I have personally communicated telephonically and via email with her several times between 30 Nov. and 9 Dec. 2016! This is clearly a case of" THE LEFT HAND NOT KNOWING WHAT THE RIGHT HAND IS DOING". I have heard every excuse from the "PROPERTUITY EXCUSE BOOK" and today, Wed. 25 Jan 2017 I still have NOT had my DEPOSIT REFUNDED backto me! My cell.no and email address has been provided to PROPERTUITY, yet their SILENCE is DEAFENING! I have also kept all correspondance, (emails, sms transcripts, etc) on file. PROPERTUITY, as an ex-tenant I WILL NOT surrender my DEPOSIT. PAYUP!!</p>
