Bad and ********* service

There is an unsavoury practice taking place with my medical scheme.

Blood test that are performed in hospital are paid out to the pathologist and charged against my out of hospital benefits rather than against the prescribed minimum benefit.

The argument is that the doctor needs to motivate each time why such additional test are required. The doctors don't have the time for this.

I haven't visited a doctor but my benefits for the year have already been used up.

Is this practice ethical and inscoordance with consumer protection laws?
