False misrepresation during the sale of a motor vehicle

I bought a motor vehicle from them November 2018, they where informed of this car being first purchase and that I would make use of it on weekends until such a time when I am comfortable to make use of it on daily basis and since then I clocked just a little over 4000kms. I raised important issues with car in question, below is email sent to the manager Sirish of this establishment:

Morning Siri,

I have been trying to sort out the problems with the motor vehicle when it was brought under attention that this sale was enticed with the use of false misrepresentation.

1. When the car was sold to me it was clearly stated that is fully fitted with run-flat tyres, with Ahmed going as far as saying to me he was just throwing in a carjack but it would never necessary because I was in the position to drive 100km’s with a flat tyre and that also being the reason why there is no provision for a spare tyre. When I took the car through for a suspension report as a request from MySure, the dangers of the driving without a spare wheel where highlighted because of the types of tyres fitted on the car, clearly stating that they were Chinese brand, not the greatest quality and most importantly definitely not run-flats .

2. Furthermore, I was alluded to the fact the warranty comes a part of purchase courtesy of your dealership, it was revealed to me that I am the one who is currently paying for this warranty to the total premium of R169.19 monthly. I am said to have pay for this supposed warranty for the entire duration of my vehicle finance whilst it only covers me for 12 months.

3. You omitted notifying me of all of the problems which comes with the car, it was discovered that the front wheel bearings on both sides are loose and the motor vehicle brake pads are so badly depleted that that I am currently driving in a fancy German coffin. I witnessed the state of the wheel bearings which is dire to say the least. I returned the car because of the sound it was making when reversing and was told by your sales person with the greatest of confidence that the sound was as a result of the car being in the garage for a long period of time only to find it was of something so serious.

This has also made me realise why the car was delivered under such duress and never affording me the opportunity to test drive and do proper checks before taking it home. I was set to fetch the car on Saturday but your sales person was just not having it and insisted that he brings the car to my house against my better judgement on the Wednesday. The sun roof leakages as well the brake pads are not covered by the warranty.

I will need a date when I can bring the motor vehicle so you can fit the correct tyres as per your sales pitch as well all the other outstanding issues that are not covered by the warranty.

The vehicle in question was purchased on the 6th November 2018, we cannot be held responsible for the normal wear tear items on the vehicle, kindly note that this should have been brought to our attention sooner Unfortunately because this vehicle was in your possession for eights months we will not be able to assist

I am disturbed by how he claims wear and tear for simply lying about the kind of wheels that the motor vehicle comes with. For the disturbing sound that the motor vehicle was making from the day it was delivered to date and them brushing it off stating that sound is a direct result of the car being parked at the dealership for an extended period.

I have barely made use of this car but today I am sitting with qoutations amounting to R16000.00 excluding the run flats and their service is literally next to zero.
