Very poor service re third party claim

In December I was side swiped by a car while stationary at a red robot. The impact damaged both my front driver's and rear passenger's door as well as taking off my driver's side mirror. The driver of the other car clearly did not see the red robot and was driving too fast to break properly . I lodged a third party claim with the other driver's insurance Prime Meridian. After 5 months of excuses I was finally told that my damages were PRE-EXISTING and that they would only pay a portion of the claim. They were calling me a **** - as per their 'expert's opinion', who had never even seen the car. Then they had the gall to tell their client (the person who hit me) this on the phone!! That is a blatant breach of confidentiality. I was eventually forced to claim through my own insurance. This cost me an amount of R7200 as I had to pay my excess of R3600 and pay back my outbonus of R3600. I will also not receive a no claim bonus for the following three years because of this claim. I was treated like a ******** from the outset with this third party claim, and to be told that my damages were NOT from this accident was devastating. Prime Meridian must explain themselves!!

WOW! What a pity that that your insurance company charges such exorbitant excesses when you claim - and then even takes away your no-claim bonus!

Despite the fact that you appear adamant that your vehicle's considerable damage was not pre-existing, the particular and limited damage to our client's vehicle is evidence to the contrary. It is entirely consistent with our client's testimony that it was merely the rear-view mirror of your vehicle that was clipped by his.

Sadly, you have declined what we felt was an especially generous offer of settlement for the limited damage caused to your vehicle and decided instead to claim from your own insurer for the full extent of all the damage that existed. In the circumstances, there seems little more that one can do in this regard.
