Unfair repudiation of claim.
On 3 February 2024 I was involved in a car accident in Mpumalanga. While I was driving, a bakkie suddenly braked in front of me and I bumped it at the back thereby damaging my car. I then lodged a claim with my insurance company (Santam) with which they repudiated my claim citing that I had exceeded the speed limit by 20km/h. On the Repudiation letter they stated that they extracted data from Event Data Recording of my vehicle which confirmed that I was driving 80km/h in a 60km/h zone. Upon reviewing the terms and conditions of my Policy schedule, I discovered that my claim was valid as I only exceeded the speed limit by 20km/h, I lodged a dispute and requested for evidence. On the second letter they sent me, in response to my dispute, they changed and stated that the data they received from the Event data Recording was 101km/h. My confusion is how can they say they CONFIRMED that I was driving 80km/h on the first letter, and when I dispute the validity of the repudiation then change to driving 101km/h. Santam insurance is trying so hard not to pay out my claim, I am unfairly being prejudiced by this insurance company.

“Following the registration of your claim, we obtained the diagnostic data from your vehicle. This data confirmed that the insured vehicle was driving at a speed of 80km/h immediately before the accident.”
Now my question is, how did this very same data change from 80km/h to 101km/h?
You confirmed that the data was received from my vehicle, and in your letter that I quoted above, you stated that, the data you received from my vehicle CONFIRMED that I was driving 80km/h.
