Rejection of a valid claim using baseless, unfounded and untrue facts

<p>My name is Siyethemba Majozi, hereby request your help regarding my accident claim rejected by Prime Meridian Insurance. On the 2nd of July 2016, I was involved in a motor vehicle accident while traveling at a speed of approximately 40km/h and I reported the accident to my insurer.</p> <p> </p> <p>On the 18th of August 2016, I received an emails from Mr Phillip Marais from the Claims Department stating that my claim was rejected on the following basis as stated by the Phillip "during the validation of the claim it was revealed that the driver exceeded the speed limit of the road where the accident occurred." </p> <p> </p> <p>On the 24th of August 2016, I escalated the claim to RMBSI (Client Representation Department) and I raised my concerns regarding that outcome, disputing their inaccurate claim that I was speeding. I was concerned that that their explanation was vague and lacked information to substantiate their basis. I then requested them to give me more information and substantive evidence that I was speeding. Mr Sicelo Tshelwane from Client Representation acknowledged the concern.</p> <p> </p> <p>06 September 2016, Mr Sicelo Tshelwane sent me an email with reasons for the rejection of the claim. Here is a snippet of the contents of the email,</p> <p> </p> <p>“Your claim reported to the administrator on 04 July, 2016 was found to be invalid and not processed further as a result of "Contravention of the National Road Traffic Act – Speeding"</p> <p>Having consulted with a qualified accident reconstructionist who has examined the scene of the accident and performed important calculations in regard to the speed at which you would have had to have travelled at, we concluded that you had been travelling at a minimum speed of 85.03 km/h in a 60 km/h zone.</p> <p>The calculations were based on your above description of the events leading up to your accident as well as the critical curve speed of the bend in the road and concluded that:</p> <p>You left the roadway on the right hand side probably as a result of the driver exceeding the critical speed of the curve which was calculated to be 85.03 km/h”.</p> <p>The speed was calculated based on crudely assumed acceleration factor with no basis. There is absolutely no basis for an assumption that the acceleration factor before the accident was 0.3. The assumptions made to arrive at the speed of 85.03 km/h were deliberately exaggerated in order to arrive at an outcome that is favorable to the insurer.</p> <p>I’m extremely disappointed by the insurance’s deliberate attempt to find unfounded reasons to reject my claim.</p> <p>In the light of the above argument I would like to be assisted with my claim.</p> <p> </p> <p>Thank you,</p> <p>Kind regards</p>

Hello Siyethemba,

We appreciate your further considerations despite the detailed response provided by our Client Representation Department.

However the expert findings regarding your violation of the NRTA remain undisputed.

We are further obliged, for the protection all road users, not to admit claims that would condone the ******** driving of our policyholders.

Accordingly, our liability towards your claim remains unchanged.
