REJECTED CLAIM

I have never been so let down by an insurance company as I have been with PMD. On the 10th of September 2022, I was involved in a horrific accident that almost claimed my life and one that I am still traumatized by until this day. On this day I was driving home from a friend’s place and I noticed that there was a car that had been following me for a while. I noticed that when I slow down, accelerate or change lanes this car would do the same even when I try to give way for it to pass. Naturally, I panicked and wanted to get home as soon as possible. In my panicked state, as I was approaching a curve I miscalculated the turn, my car went off the road and hit a barrier. At this point, I lost control of the car and it eventually plunged into a ditch. The impact was so hard that I lost consciousness for a while until I was assisted by traffic officers. Paramedics also came into the scene, I had a few scratches and bruises but no fractures, however, the car was badly damaged. I reported the accident later on that same day at the nearest police station and lodged a claim with PMD a day or two later. I submitted all the necessary documents to process the claim and a day later I received an SMS advising that the car is a write-off. On the same day, I received a call from someone who had been assigned to my case and I was asked to give a detailed report of what happened on the day of the accident and I explained everything to the best of my memory. The insurance kept calling me for more information and I remained patient, compliant, and cooperative the whole time. Roughly after two weeks, to my dismay, I received a call from PMD advising me that my claim has not been approved by the insurance on the grounds that I was speeding. According to their specific behavioral exclusions, they will not cover any claim where at the time of the accident the driver was exceeding the speed limit by more than 20km/h. I asked how they have arrived at this conclusion because in the statement that I gave I said I remember driving around 100km/h and my tracker confirmed that I was driving at 116km/h at the time of the accident. I was informed that they had hired Accident Reconstruction Engineers who after assessments advised them that I was driving at 141km/h. I disputed this and I have been going through their internal complaint/appeal process with back-and-forth communication with their legal team asserting that they stand by the initial outcome to reject the claim. This is even after submitting evidence from the tracker which has a date and time stamp same as the date and time of the accident. It has been over a month now and they say they are still “investigating my concerns”. I switched from my previous insurance with the promise that I was going to get peace of mind with PMD but over and above the trauma that I am currently dealing with having been involved in that horrible accident, I find that I am more stressed, depressed and hugely inconvenienced which is opposite of everything they promised me. Is this the service PMD provides to its clients? Is this how they “strive to deliver the fairest possible outcomes”? Is this the peace of mind they promise? Can you trust that PMD will come through for you when you need them the most? Can they protect you from losing your valuables when accidents happen?
