PMD not using genuine parts to replace/refit

I claimed for Windscreen from PMD December 2019. They assigned the job to Bsg (glass company). The job from Bsg was bad that I wanted them to refit the windscreen again. The reason why PMD chose this company is because they don't want to pay, the total cost of the windscreen was R2300 because it was not a genuine windscreen.

Fast forward to beginning of February 2020, I took my car to Mercedes benz for service, it is still under maintenance plan. After Mercedes benz serviced my car they advised that the windscreen fitted on my car is not a genuine windscreen and if I do not replace it, it will impact my maintenance cover. Mercedes benz quote me R9300 for the windscreen.

I called PMD to let them know that by Law they are not allowed to fit in parts that are not genuine into a vehicle. They told me about a hidden clause in the contract where it says they are allowed to use second hand parts to repair or refit any parts. But my argument is that this part is not second hand part. The issue is that it is not a genuine part that is required by Mercedes benz.

I am going to lodge a compliant with Insurance Ombudsman and subsequent to that I will be taking legal action.

If you are looking to take Car insurance with PMD, please think twice, because there are alot of hidden clauses in their contract. The premiums might be low compared to other insurances but it is not worth it.
