PMD is a ****

**PMD Rejected My Claim After Years of Paying Premiums**

I have been a loyal PMD policyholder since 2020 and have paid my insurance premiums every month for almost six years without submitting any claims.

I was involved in a hit-and-run accident at the intersection of the N12 and Impala Road. The third-party driver fled the scene and could not be identified. I immediately reported the incident and submitted all documentation requested by PMD and their claims administrators.

To my surprise, my claim was rejected on the basis that I allegedly "failed to exercise due care." However, no detailed explanation or evidence has been provided to show how I failed to exercise reasonable care or how I was responsible for the accident.

I purchased comprehensive insurance specifically to protect myself in the event of an accident. My policy schedule states that I have comprehensive cover for accident damage, yet when I needed assistance, my claim was declined without what I believe to be sufficient justification.

As a result, my vehicle remains at the panel beater and I have been told that I must pay approximately R4,400 to have it released. I have also incurred additional transport costs and significant inconvenience while being without my vehicle.

What is most disappointing is that after years of faithfully paying premiums and never claiming, I feel that PMD has not treated me fairly. Instead of receiving the support I expected from my insurer, I have been left financially prejudiced and still waiting for a satisfactory resolution more than 15 days after the accident.

I am appealing the decision and have escalated the matter to the National Financial Ombud. I hope PMD and Santam will reconsider the claim, provide proper reasons for their decision, and honour the cover for which I have paid over many years.

The full response you were talking about is the emai I got instructing the panel beater to release my vehicle on the basis that my claim has been repudiated.
I am extremely disappointed that I learned of this development indirectly through correspondence addressed to the panel beater rather than through direct communication from PMD. As the policyholder, I would have expected the courtesy of a direct explanation of the outcome, the reasons for maintaining the repudiation, and the evidence re**** upon.
To date, despite my repeated requests, PMD have failed to provide any evidence supporting the allegation that I failed to exercise due care or breached any provision of the policy.
My policy schedule reflects that I purchased Comprehensive Cover, including accident cover, and I have paid my premiums faithfully and continuously since August 2020. Throughout this period, I have re**** on PMD's representations that I would be protected against accidental damage to my vehicle in accordance with the policy terms.
The accident involved a hit-and-run third party, yet no evidence has been presented showing that I was speeding, driving recklessly, under the influence of alcohol, disregarding traffic laws, or otherwise acting negligently. In the absence of such evidence, I reject the conclusion that my claim can simply be repudiated. Give me all my premiums for 6 years then since i never claimed.

Hello Kabelo,

Thank you for your post. We understand the impact of being without your car and the frustration around having to pay release fees.

At Prime, we are committed to making fair and equitable decisions on all claims.

Our review indicates that your claim was declined due to a failure to exercise due care, as you did not slow down at a busy intersection where the traffic lights were not operational. However, as a gesture of fairness and goodwill, we have arranged for the release fees to be waived. This means your car can now be released at no additional cost to you.

Our Market Conduct Team has been alerted and will be in contact with you to provide further clarity.

We understand how difficult it can be to be without your car. At Prime, we offer an optional Car Hire Benefit which ensures you stay mobile while your car is being repaired. Committed to resolving your concern with care.

Kind Regards,
The Prime SA Team
