<p>1. On the 15th January, I had an incident whereby I hit a pothole in a road between Wolmaranstad and Zchweizer-reneke (R504), of which it resulted damages to right hand side tyres (front &back) and a dent on a fender. refer attached photos!</p> <p> </p> <p>2. After the incident I called Prime Meridian road assistance to assist me with the towing of the car, of which they did assist me after +3hours.</p> <p>3. On the 16th I made a call to make a claim relating to damages in the car, of which on the 17th January 2017 forms were sent to me to fill in, and send them back together with photos.</p> <p>4. I did send all requirements as requested. and I was receiving sms updating me of the progress (sms such as "good progress is being made on your claim! you have entered phase 2 of the claim process and your file has been sent for desktop review", "We have successfully completed your drivers license validity check" etc</p> <p>5. On the 25th January 2017, I received a call from Mr. Donovan Olivier from prime meridian direct.. asking me to answer some questions of which I agreed to, and he proceeded to ask me questions, of which during our question and answer session I realized that the questions he was asking me is the same question which I answered in one of the forms that they had sent to me. and I asked him why was he asking me the questions of which I have already answered on the paper question form and he told me he needs to complete that telephonically. we proceeded with question and answer, of which at the end of the call he informed me that he will send me internal quotation they did and some other forms that I have to fill and sign.</p> <p>5. I received the quotation and the forms he wanted me to fill and sign, of which the forms were to give permission to get information from my cellphone service provider (Vodacom). at first I did fill in the form and sent them back to him of which after some time I realized that I have actually given a permission to Prime Meridian to access my phone, I immediately checked my policy documents to see if this was bending. I noticed there's nothing on the policy documents and I therefore send Mr. Donovan Olivier an email asking him to withdraw the forms I have just send to him relating to giving him permission to access my details from Vodacom.</p> <p>6. The following day Mr. Donovan Olivier called, he wanted to confirm my withdrawal of the forms I send him. of which I did confirm to him that indeed I was withdrawing the forms. During phone call conversation I did ask Mr. Donovan, the reason behind requesting such permission, and he told me it was to prove that indeed I was the driver of my car that day, I told him if they didn't believe me why don't they ask towing company whom they found when they came to tow the car.. to my surprise he changed the story saying they want to know the tower of the area where I was when I had an incident, of which I responded by saying I can call Vodacom to give me such.. also I can make contact to BMW because whilst I was waiting for confirmation of a towing company from Prime meridian towing, I called BMW using the emergency telephone provided in the car, so they have a record of my call and location. he said to me I wont be able to get that from Vodacom and that they're not interested in BMW data as they want cellphone data from Vodacom. I further asked him since well they wanted the data of the area where I was, why on the forms was it requesting data as from 14H00pm to 19H00pm, hence I mentioned I had an incident between 16H00pm and 17H00pm. he told me the minimum required hours from Vodacom is 5Hours. we continued to go up and fourth.. but at the end I told him I'm not giving them such authorization because I feel is violation of my privacy. and he said to me since well I'm not cooperating he's going to send me a non-cooperation latter of which I told him he may proceed with that</p> <p>7. He did send me Non-cooperation latter (attached) as promised.</p> <p> </p> <p>Concerns - during my acceptance of my policy i.e telephonically the was never a point where it was mentioned that should I be involve in an incident/accident phone data will be requested from my service provider.</p> <p>- Policy documents I received does not mention if I'm involve in an incident/accident cell phone data will be requested from my cellphone service provider.</p> <p>- Had I lost my phone/ not carrying it, does it mean I was not going to be covered?</p> <p>- Had I lost my life during the time of the accident, whom was going to grant them permission to access my cellphone service provider?</p> <p>- Why is it so important to get my cellphone data from service provider?</p> <p> </p>
