Unwillingness To Repair Negligent Damage Caused To Me

<p>On the morning of 14 September, whilst driving in Pretoria CBD, the driver of a Coca- Cola delivery truck hastily and negligently changed lanes without properly checking his blindspot, which resulted in him hitting my car (in the front driver’s door). Unfortunately there was no way I could escape as I was in the extreme left lane. There were cars parked to my left, a car in front of me, and had I hit my breaks the long truck would have hit me anyway and swept me off the road, and onto the cars parked to my left.</p> <p>The truck driver accepted negligence, and even communicated this the METRO police officers who attended to the accident scene to issue the accident report. He even communicated his negligence to the truck owner (Dan Skhosana from Thamana Distributors CC), who agreed to put the claim through his insurance (which he advised was with ABSA) and have my car repaired speedily.</p> <p>Although there were initial delay tactics on the part of Dan, constant pushing from me and my husband with Dan continuously referring us to his insurance who advised he had been dishonest and had not put through the clam, Dan did eventually put the claim through. The Broker (Premier Claims Services) acknowledged having received the claim, advised which documents they required to process the claim and also requested to us to immediately refrain from communicating with their client- which we did.</p> <p>Two months and 14 days later my car has still not been repaired- despite their client being the negligent party and having communicated this to them. I have begged, pleaded and done everything in my power to appeal to them to treat this matter with the urgency it deserves. </p> <p>Communication from Premier Claims Services has been painstakingly slow. If I do not contact them, there is silence from their end. Each time I contact them, I am told they require additional documents or they claim they did not receive documents I had already mailed them-requesting me to resend. Or they tell me I mailed them incorrect documents. I constantly have to push them to acknowledge having received my mails and the documents contained therein.</p> <p><br />I have asked them numerous times to advise when my matter will be concluded. They do not bother to respond to me.</p> <p> </p>
