Toyota Hilux breaks down barely 2 months after being sold to us (with 4 month old baby and dogs in car) due to previous damage and requires new engine - Dealership refusing to honour CPA obligations

My husband purchased a 2013 4x2 Toyota Hilux from this dealership in at the end of October 2016.

We drove down to Cape Town exactly once and on our way back over the December holidays the car broke down. Note that this was in 38 degree weather with my 4 month old baby and two senior dogs in the car.

The car is still in Stellenbosch and due to work obligations, we have had to fly up and leave our dogs (Great Danes) with family. You can imagine that this is traumatic both to us as well as to them.

The assessment from the workshop appears to be that there was previous damage to the car which resulted in it overheating. The ENTIRE engine has to be replaced, the current quote sitting at around R90 000. The warranty which was sold to us at a cost of R9000 covers exactly R7000 and therefore is not worth the paper it was printed on.

Understandably having just spent a considerable amount of money buying the car, we do not want to have to pay even more money to replace the engine. The dealership is now refusing to honour their obligations in terms of the Consumer Protection Act as we have requested a refund.

This has not only ruined the end of 2016 but also the start of 2017, caused us untold stress and left us without a car. Not the way I would expect a reputable dealership to operate.
