The company has sold me a vehicle with a Code 3 status without disclosing it and they are refusing to take the vehicle back and refund my money.

Thank you for your email and for your prompt response to my complaint. However, I would like to dispute the fact that I was informed that the car I purchased from the dealership was a Code 3 vehicle. I request that they provide me with signed documentation to confirm this. I was not made aware of this information prior to purchasing the car. I would like to clarify that I only became aware that the vehicle was a Code 3 when I received the registration certificate from the dealer, and I was informed by my salesperson, Mr. Dumo, that the car was never in an accident. I have attached a screenshot of our WhatsApp conversation for your reference.

Furthermore, I would like to bring to your attention that when I viewed the car on January 21, the screen was showing that the brake pads needed to be changed. I paid the balance on January 27 and went to collect the car on February 1. I noticed that the car had a drivetrain faulty sign, an SOS faulty sign, a washer fluid faulty sign on the dashboard, and the number plate was falling. I left the car with the dealership to fix these issues, and I collected the car on February 11.

On February 18, I took the car to BMW for a quality check, as I felt that the dealership was not entirely open about the condition of the vehicle. The vehicle failed the quality check, and a list of issues was identified. I have attached the document from BMW for your reference. I also took the car to Dekra, and the technician identified a lot of parts that were damaged and spotted a leak on the CV joints. I have attached Dekra's documents for your reference.

As a result of these issues, I requested that the dealership refund my money. However, Hendry informed me that he could only offer 50% of what I paid, or I could bring the car back and wait for him to sell it so that I could get my money back. Neither of these options were suitable for me, as I need a car for my daily errands.

I then lodged a complaint with MIOSA. On March 20, the car stopped moving, and I paid R10,000 to a mechanic to fix it. I will send proof of payment shortly for your reference. He tried his best, but the car still does not have power when the AC is on, does not pass 130 km/h, and the drivetrain sign comes up when I drive on a steep slope.

I would appreciate it if you could help me get my money back and buy a car that is in good condition.
