Unsolicited Direct Marketing and Breach of Section 69 of the Act

I am writing to formally request that Platinum Life cease all direct marketing communications to me, as required under Section 69 of the Protection of Personal Information Act (POPIA). This section of the Act explicitly prohibits direct marketing through any form of electronic communication unless the data subject has provided clear and unambiguous consent.

Since 2013, I have been receiving annual calls from Platinum Life. These calls are typically the result of a referral, not from family or friends, but from clients of my former baking business, which has been closed for several years. I have had the same phone number for 13 years, and I want to state unequivocally that I have never given my consent for my personal information to be shared for marketing purposes, nor have I authorized anyone to provide my details to Platinum Life or any other entity.

I have repeatedly informed your representatives that I do not wish to be contacted under any circumstances, even if referred by someone else. Despite these clear instructions, I continue to receive unsolicited calls. Please understand that I have no intention of accepting any free gifts, marketing offers, emails, or calls from your company. Additionally, my immediate family, consisting only of my husband and two children, would never share my personal details without my explicit consent.

Given that I have never provided consent, and have made multiple requests to be removed from your contact list, I believe that these continued calls constitute a violation of my rights under the Act. I respectfully demand that you immediately remove my contact information from all of your marketing databases and ensure that I receive no further communications from Platinum Life.

Failure to comply with this request may result in my taking further action, including but not limited to lodging a formal complaint with the Information Regulator.

Please confirm in writing within 14 days of receipt of this letter that my contact information has been removed from your databases and that no further marketing communications will be sent to me.
