UNSOLICITED CALLS FROM PLATINUM LIFE

I have been harassed by Platinum Life receiving over 15 calls in a span of two days. I didn't not sign up for any Platinum Life services however I am being mobbed with calls from them which is a direct contravention of the POPI Act as I did not given consent to marketing from Platinum Life nor am I a customer of the person from who they claim they received my contact details from. I will be reporting this matter to the Regulator as this is a contravention of the Act and should be dealt with accordingly so that Platinum Life stops mobbing people with unsolicited calls.

Dear Gontse,

POPIA compliance is very important to us and we always want to ensure that we are fully compliant to the all the act prescribes.

POPIA does allow for direct marketing and we are not in breach of any of the 8 conditions that the Act prescribes. You were recently nominated by a friend or family member for a promotional gift. Our team has tried to contact you 3 times in order to get your consent. The gift is optional and we never want you to feel overwhelmed by any calls received.

We fully respect your wish not to be contacted by us again and so have added your contact details to our Do Not Contact list so that, in the event that you are again referred to us in the future, we will not attempt to contact you.

Kind Regards

I was not contacted 3 times, I was contacted over 15 times and have the call logs and block list of the multiple different numbers that Platinum Life used. I am more than happy to share the call logs so that there is no confusion and the lies can stop. You are in fact in contravention of Section 69 - Direct marketing of the POPI Act however I will leave it to the Regulator to provide further clarification for you on this matter as I am in the process of filing a complaint against Platinum Life and will offer the same call logs and block list the, I have offered to Platinum Life above, as evidence. The blatant lies to say that you only called 3 times when I have a call log is baffling and speaks to the credibility of the company.

I was only able to find 3 calls made to your number on my system, but you are welcome to send the screenshots to ***, but I am currently following up with our referral team.  I am trying to assist and advise based on the information I have available and I apologize if there is any discrepancy. I am more than willing to follow up further and investigate the matter accordingly. The section to which you refer is section 69 which also allows a responsible party the opportunity of approaching a data subject for the purpose of obtaining such consent.

The email in your response is hidden, below are all the numbers registered to Platinum Life that I received calls from between 08/04/2024 and 09/04/2024, from some numbers I received more than one call, now please clarify how 10 numbers only made 3 calls and where I received the rest of the numbers if you are claiming that you only called me 3 times:

I did not authorise anyone to give out my number, just because someone is a "friend" or "family" does not legally give them the right to give out any of my personal information as that is a breach of privacy *******ly. Please again clarify how you received my number to "obtain consent" when I have never interacted with Platinum Life in anyway before I was mobbed by calls.

My sincere apologies for any confusion regarding calls being made to you. I am following up with our referral team to see if they can confirm the different calls made to you and why we are unable to view it on our side. Kindly note that I have asked our information officer to contact you directly regarding this matter in order to best address your concerns about the referral process and our compliance with POPIA.
