CONTRACT CANCELLATION SUPRISE AND ANTICS

After 11 months of renting a vehicle that was written off and rebuilt. I cancelled my contract on the 25 May 2024. After weeks of requesting where I should drop the vehicle off. On 24 June 2024, I recieved an email that an email that read as follows. As per the Vehicle Rental Agreement #*** a termination by the Renter is subject to a fee of up to 7 months' rental payment. This means that you are liable for a total of R51289.00. However, because we are interested in settling this matter quickly we are prepared to offer you a settlement deal of only R21978.00.

I requested a break down of amount. The email sent said "its your arrears amount were R14654.00 before termination plus 1 month termination fee." My termination would be the instalment amount of R7327. Which makes a total of R21981. Which doesnt align with the settlement discount amount.

At the time of cancellation on the 25 May 2024, there were no arrears. Planet42 then started saying to me that I had claimed from insurance for repairs and then they used this as a delay mechanism not to give me the address where I should deliver the vehicle. They then gave me the address on the 21 June 2024 and I delivered the car in Menlyn on the 22 June 2024.

I have reported the matter to the Consumer Goods and Services Ombud: CGSO. The reference number is iD-Y4L1LMP4. I have also complained about the dvertising to the Advertising Regulatory Authority and the reference number is ***. I have also served them with a Small Claims Court Summons for the amount of for storage while they would collect the vehicle.

I HONESTLY WOULD NOT RECOMMEND PLANET42.

Planet42 has responded that I owe May and June 2024 amounts. This cant be true becuase clause 6 of the contract says that rental is paid in advance. Therefore May 2024 was up to date. They then refused to supply me with the address where I can drop the vehicle. They finally supp**** me with an address on the 21 June 2024, and the car was delivered. I then subsequently issued Small Claims Summons for the Storage fee amount while they were not providing me with a drop off address for the vehicle. Mind you, I had never paid late and had been supp**** with an unroadworthy vehicle. When you claim on their so called warranty, they will require a service history. How can you have a service history on a code 2 or code 3 written off vehicle. When I got a quote for the warranty it came to R70000 and the mechanics at Car Service City Hatfield, advised me not to drive the vehicle as it would kill me. When I obtained the vehicle in May 2024 from bonus cars. The gear werent working. I had to buy a gearbox. The fuel guage was faulty and I had to buy and replace it. All the while I was paying Planet42 diligently. Anyone who wants a copy and proof of my claims, my email is ***.

On Monday 21 October 2024, Planet42 and I will be at the small claims court. Im claiming storage fees since they ignored me for a month after I cancelled my contract. They are now also claiming that I owe a non existant amount..... They are the worst......
