Unfair treatment
My son was lured into taking a gym contract at Planet Fitness Roodepoort in Ruimsig in Sept 2018. The salesman told him and a friend that the gym has a promotion on membership fees for students and it will cost R200.00 for the duration of the contract. Since my son was working after varsity as a sports coach at his former school, he felt he can handel R200 a month easily. My son paid the account monthly. However after a few months he recieved a message that his account was in arrears and that he should contact the gym in that regard, which he did. He wasnt happy with the explanantion given him on the phone so he asked me to accompany him to the gym to go and deal the matter. We spoke with the gym manager who tried to assist us but it became clear Planet fitness would not budge. We were told that those saleman were no longer in the employ of the gym and that the promotional tariff was only for 3 months in the contract and thereafter it would revert to R400.00. last said was not discussed with my son and his friend at the time of the sale.
I then requested a setlement which my son received via sms. It also stated that he had 7 days to settle it, after which i told my son to call them and advise that he would only be able to settle the account as the 25th for that was his pay day at the school, and they agreed to it saying they will make a note of it. Great stuff we thought. in July of this year, Landau attorneys contacted my son to collect on his outstanding account with Planet Fitness. My son being young and still a student had a shock to get such a call knowing he comp**** with the arrangements and so we had to explain even provide written evidence to the person at the firm at which she acknowledged that she can see the settlement was made and that he requested a cancelation.
Yesterday my son received yet another demand from the same attorney firm for the settlement. I once again assisted him to draft a responce reminding them of the fact that they, (Landau attorneys) acknowledge the fact that he paid his settlement and requested cancellation. They called him today and said yes they did say that they will look into it but because he didnt pay within that innitial 7 day period (which he did inform them when he'll pay and they agreed) he now has to pay again. I did threaten her that im going to consumer watchdogs and all over the show to expose the gym for this level of unfair treatment Id like this matter to rest once for all, but would like to expose the gym for their underhanded behavior prying on young innocent students who knows very little about consumer law and their rights as consumers.
