********* PRACTICE - restarted membership without consent

<p>In July I enquired about my options should I cancel my vitality membership. I was advised by planet fitness that what discovery had told me was CORRECT: That once my vitality was cancelled I would be offered the option to cancel it OR renew at the standard rate. </p> <p>I proceeded to cancel my vitality membership on the premis that I would be able to cancel the PF contract. I was shown that it was set to DNR on PF system and that they would wait for their system to update RE the vitality cancellation, before they were able to cancel the contract.</p> <p>I followed up a few weeks later after not receiving a call, and was advised by a call centre agent that my membership was indeed cancelled, and that I had made my last payment and there were no penalty or cancellation charges due. </p> <p>A few weeks later (16th August)...my account was debited by PF for the full membership fee of R399! I went back into the club (17th August) to enquire as to what was going on...I was told by staff that my membership was "restarted" on the 1 August. I had NOT given consent to do that. After calling PF call centre thereafter, and explaining the series of events I was ensured that they would log and process a refund and that my contract would be cancelled once and for all and that I would receive the refund within 14 working days.</p> <p>On the 14th working day (5th September) I called the call centre again. I was advised that the refund had been logged awaiting manager approval. The manager was not available to update the status. I was told I dont need a REF number and that she will get it sorted straight away and email me confirmation. That never happened.</p> <p>(7th September) I followed up with the call centre and spoke to a arrogant person who gave very bad service and did not listen or let me finish my questions etc. He did not want to understand the situation. I explained that I was awaiting manager approval for a refund, his response?: "You wont be getting a refund" Back and forth disagreements ensued and after asking to speak to his manager I was told I cannot. After insisting, he arrogantly suggested that I was not about to wait 2hrs. After challenging him I was on hold an awfully long time (unneccessarily) and then told nothing had changed. He referenced the terms and conditions to which he could not quote, using the excuse that he had a "bad copy". He asked to speak to the clubs admin manager for a copy of my contract and then hung up without leaving me a refernce number!</p> <p>The Parklands (Cape Town) clubs admin lady Nicole has been helpful and is now following up for me and has agreed that they should refund my money as I was advised:<br />1) it was cancelled<br />2) there would be no further fees<br />3) membership was restarted without consent<br />4) call recordings prove the series of events above are true</p> <p>I will not rest until they have refunded the (now) TWO amounts that have been debited since I was told it was cancelled!</p>
