Cancellation of Contract
Hi there,
I joined Planet Fitness Waterkloof in November 2017. I received my Welcome mail on 30 November 2017, however, I never received a copy of my contract.
In April 2018, I moved residence, so moved my membership to a closer gym. Also feel it necessary to mention that I got charged twice that year for "Maintenance" fees, but regardless.
As per NCC spokesman Trevor Hattingh, “Legally when someone’s gym contract comes to an end, the consumer must be notified between 40 and 80 days before the contract ends. It is the service providers’ obligation to inform the consumer personally to give them the option of continuing the contract and explain the new terms and conditions should they wish to continue,” he said.
After not receiving a notification from Planet Fitness stating that my membership was coming to an end in November 2018, I sent them a formal mail explaining that contrary to contractual obligation they have not notified me and I was cancelling my membership as this was a year later on the 28th of November 2018.
I only received a response on the 12th of December stating that I had to pay R1711 within 7 days as my contract was still within minimum-duration. I responded explaining that I had signed a 1 year agreement in November of 2017 and that a year has passed. At no point during the membership transfer had anyone mentioned that my contract start date was reset. Furthermore, I never signed any further agreements and thus consider my contract ended in November 2018.
I have since sent 4 follow up mails, all of which have been ignored.
They tried to debit my account end of December and today, they debited my account twice - R438,90 and R458,90. I cannot fathom where these figures come from but I demand an immediate refund and confirmation of cancellation! If I don't hear from Planet Fitness by End of Business on Tuesday 29 January, I will take the matter further, as this is ********
