I joined the gym in 2022 on a fixed contract. As part of the contract causes it clearly states "We will let you know when your membership is coming for automatic renewal and will do so atleast 40 business days before the end of the minimum contract duration (fixed term)". They have not done this, neither have they sent any statements since I joined. I believe they deliberately do this to maximize revenues before threatening blacklisting you. So in 2025 they send an sms of summons (3 years later). The legal firm they use couldn't even give any details of the claim they are pursuing until I went to the gym to get a copy of the statement and contract. The contract would have now been continuing on a month to month basis. How can a month to month contract continue for 2 years if you are not atleast running debit that are just bouncing etc. The contract states that they would be entitled to terminate it if there is a material breach. Is non payment on a month to month for 2 years not a material breach? It is not if you are intending to maximize billings.
