PEP sold me a cellphone set with a latent defect

PEP CELL sold me a celphone set with a known latent defect. Its battery life is about 3hours when I am not even doing anything on it. I bought a cell from PEP CELL on the 24th Jan 2016. I returned a week latrwhen I realised that the staff did not give me a charger ( the phone s screen protecting sheet is also wworn out). After charging it twice and realising that its battery life is zero , i tried to return it to the shop but was told that the return policy is only 7days from sale by Nthabiseng.<br> The staff did state that they are aware that the phone needs to be charged almost all the time and that they do remember that i had returned for the charger a week later, yet they refused to refund me.<br> They are in breach as they misrepresented from the onset by not disclosing the \latent defect\" in the battery life of the phone. More-over by not giving me the charger immediately, they ensured that they limit the window period so that by the time i come back for the charger, the store's 7 day return period has expired. Can i please get my money back as this is a clear breach of S20 of the CPA and many Common law principles<br> Please see this as a notice of intent to terminate the contract. "
