mobicel and Pep i am so disappointed
i bought a mobicel PR something, not even certain of the model because i am so frustrated. i bought the phone at Pep cell, in kaalfontein, i paid R 1099. the phone started giving me problems on the second week, when i took it back i was informed that they could not assist me as they are only allowed to fix or exchange the phone within 7 days. The phone is defective, the screen just goes blank. I asked one of the technicians from work to look at it, but not to disassemble it or fiddle with is as it would mean that i tampered with the gadget and cannot apply the CPA.
i feel de*****ed. Section 55 of the Consumer Protection Act of 2008 (CPA) guarantees the Consumer's rights to safe and good quality goods.
In terms of section 56(1) of the CPA, any transaction or agreement is subject to an imp**** warranty by the producer, retailer or supplier, to the effect that any products produced, supp**** or distributed should comply with the quality requirements and standards.
i did not get a device that met the quality requirements and standards a stipulated in the CPA. the technician stated that the phone was faulty and that he can see that the product was not properly put together as it was too loose.
all i want to know is this, is mobicel above the law to sell us defective products then tell us that we will not be assisted should 7 days pass without us returning the product o escalating a complaint.
the agents at Pep also were reluctant to assist and a bit rude. However i understand as they are only following the rules that were given by mobicel. They should however learn to be a bit understanding and empathetic towards the clients.
this is ridiculous, i will be taking this up with the NCC.
