Cellphone damaged

My husband purchased a cellphone from port Edward was a gift to me we are from Chatsworth the box was sealed the store didn't even check if the phone was working or anything was wrong when I opened the seal and the box the phone was cracked on the side I called the store they did not answer I contacted customer care they advised me they cannot help me as I need to take the phone back to port Edward which I cannot coz we are from Chatsworth its really frustrating buying a cellphone which Is was broken and no one wants to help
