Complaint against Penta Omada – CPA Breach: Unresolved Airbag Safety Defect
I am lodging this complaint against Penta Omada due to the ongoing failure to resolve a serious airbag safety defect on my vehicle, which was purchased brand new.
I first reported the airbag warning light fault at the end of November. Since then, I have contacted Penta Omada on multiple occasions. Technicians attended to the vehicle and confirmed that the fault was resolved; however, within minutes of collection, the airbag warning light reappeared, indicating that the repair was ineffective.
I subsequently took the vehicle to Penta Montana, where I was informed that the issue is a mechanical defect requiring the replacement of a specific part. I was advised that the part had been ordered. Despite this, it is now January, and I have received no clear communication, no repair timeline, and no resolution.
This matter constitutes a safety-critical defect. Due to the unresolved airbag fault, I am unable to sell the vehicle, as doing so would pose a potential safety risk. This has resulted in financial loss, inconvenience, and ongoing stress.
In terms of the Consumer Protection Act (CPA), specifically:
Section 55: Right to safe, good-quality goods
Section 56: Imp**** warranty of quality
I am entitled to a vehicle that is safe, durable, and free of defects. The prolonged failure to repair this safety defect within a reasonable time is unacceptable and non-compliant with the CPA, particularly given that the vehicle was purchased new.
I hereby request an urgent written response by 09:00 tomorrow morning, clearly confirming:
The status and availability of the required part
A confirmed repair date
The immediate corrective action to be taken
Should this matter not be resolved without further delay, I will formally escalate the issue and exercise my rights under the CPA, including a request for a replacement vehicle, as the product supp**** is not fit for purpose.
