Waiter stole my money

The waiter did the transaction. However they ran out of paper on the machine while I had already entered my pin and was waiting for approval. The waiter went to go fetch paper and thus I trusted that the machine malfunctioned and did not take my money so I had to do the transaction. 2 days later, reviewing my bank statement. I notice that the transaction went through twice, however even the waiter wasn’t honest enough to notice that we had significantly overpaid the bill
