PAYFLEX *********Y TAKING MONEY FROM MY ACCOUNT

I have been purchasing from different stores using Payflex for a long time now, I have the app on my cellphone to track all my orders. I have 3 cards loaded on my profile. But about 2 months ago my husband kept asking me what did you buy now again, because payflex keeps debiting his account, as his is 1 of the 3 cards loaded on my profile. I thought my husband was crazy, until I checked the bank statement and found that we don't even have an order for that amount. Led me to check all my order and found that they were just taking money from his account more that R200 at a time. I am taking this further and will have my lawyers on this!

Hi Malikah

Payflex have not done anything ********* and have worked within the terms and conditions you agreed to when signing up with Payflex.

Payflex have been trying to debit the 3rd instalment on the Cotton On order since the 26 Dec. However, your bank kept declining us.

 So as per our terms and conditions we debited the next available card on your Payflex profile.  This relates to the payments on Payment Plan *** which was the order from Cotton On for R464.99.  Please see payment plan schedule below.  Payment: 1; Amount: 116.24;AmountDue:0.00 Date: 28 Nov 2022; Status: Paid on 28 Nov 2022 Payment: 2; Amount: 116.25;AmountDue:0.00 Date: 12 Dec 2022; Status: Paid on 12 Dec 2022 Payment: 3; Amount: 201.25;AmountDue:0.00 Date: 26 Dec 2022; Status: Paid only on 31 Dec from your husband’s card with a R85.00 late fee. Payment: 4; Amount: 116.25;AmountDue:116.25 Date: 9 Jan 2023; Status: Pending

We do make it very clear that when using Payflex one should never load another persons card, unless you wish to use that card for payments. This is detailed in the Do's and Don's on our registration page.  https://payflex.co.za/customer-registration/

Below is the extract from the page for easy reference highlighting the card comment.

 Do’s and Don’ts when Registering and using Payflex to Pay

Do’s

  • When you register with Payflex only use your Name, ID, email, and cell number.
  • When paying with Payflex only log onto your own Payflex account.
  • When buying something new or paying for an existing instalment, only use you own bank card.
  • When submitting queries to the Payflex support team, use the email address that you registered with Payflex.
  • When submitting a query to the Payflex support team please ensure to provide all relevant details such as your ID number, cell number, date of transaction, transaction value etc. The more information you provide the quicker our team will be able to assist you.
  • Budget correctly when you buy to ensure you can meet the payments due every 2 weeks. This will ensure you don't land up paying penalties on missed payments.

 Don’ts

  • When you Register with Payflex, don’t use someone else’s Name, ID, email, and cell number.
  • When paying with Payflex, don’t log onto someone else’s Payflex account.
  • When buying something new or paying for an existing instalment, don’t use someone else’s bank card.
  • When submitting queries to the Payflex support team, don’t use an un-registered email address.
  • When submitting a query to the Payflex support team please don’t send a one liner or vague request.
  • Spend responsibly. Don't buy unless you can meet the payments due every 2 weeks.

So as you can see this was not done without your express permission. This is because:

1) You loaded you husbands card at some point and this was 3D secure approved by your husband and bank.
2) When you signed up with Payflex you agreed to the terms and conditions. Our terms and conditions specifically state that we can debit a card on your profile. See section 8.3 of the terms and conditions https://payflex.co.za/terms-conditions/ which is extracted below for you ease of reference as well.

 8.3. In the event that we are unsuccessful in obtaining payment from your Primary Card for an Instalment on the due date, you irrevocably authorise us to:

8.3.1. take payment of the overdue Instalment Payment including any Default Fees from any Card that is loaded on your Payflex profile at any date.

8.3.2. accelerate the due date of all future Instalments for the Instalment Plan that is in arrears, and take payment from any Card on your Payflex profile at any date;

8.3.3. accelerate the due date of all future Instalments for any other Instalment Plan you may have, and take payment from any of your Card accounts at any date;

We trust this explains in detail what has occurred here.

Regards

The Payflex Team.
