Infestation at my unit and Pam Golding refuses to take responsibility

Hi guys. Iv been renting with Pam Golding Bloemfontein for 3 years now. When moving into my unit I was told by Pam Goldings representive that my unit has ****roaches and that it would be fumigated in a week. I have an Affidavit from the previous tenant where he states that he moved out because of the infestation. He told me on the spot of moving but Pam Golding promised to come in a week and I trusted them. At the time of moving in I had a very sick family member, I also help families living with disabilities and I have a disabled child myself- I was never really home. Fast forward to when I was permanently home with my son. The unit was bad. They were/are all over my couches, the kitchen is worse, inside the cupboards, inside my appliances. My laptops, tv, Iv had to replace 3 microwaves, two kettle, they are glued to my fridge, toaster smells, the oven is filled with them and my soundbar is dead. They go into the food while eating and when cooking. When I visit people they crawl out of my bags. My mother is now complaining about having ****roaches at her house and a few friends of mine that believe they got it from me. Sometimes I have to bath with these things!

I tried to communicate with the Pam Golding representative. He never came. I started communicating with one of the Agents and she also never did anything about it. She did tell someone to come fix a leaking toilet for the first time in three years, no yearly inspection done, nevertheless it was never entirely fixed. I asked again about the ****roaches and I was told they need a specialist therefore I need to pay for it out of my own pocket. I also tried to communicate with her about a rent negotiation because theres people who pay R5000 for what I’m paying R8400 for. The communication started in September and till today, nothing. She blueticks my messages and no respond to emails. So I realised my means of communicating with Pam Golding were of no use so I ultimately decided to open a case with Housing Rental Tribunal. I just came out of meditation with them and they said the representative no longer works for them, after years of living here what are they suppose to tell the owner, after 3 months it’s my problem and I was suppose to contain the problem. I tried to tell them that this is a unit problem, not my problem because I found these things here. They are not taking any responsibility that they never fumigated nor tried to help with the ****roaches. I wouldn’t be here had they fumigated this place and now they are saying it’s my fault. All of this does not make sense. The mediator tried asking them to be humane for the decency of their company and their tenant, to take out a R1000 to fumigate. They said no. Now I don’t have a problem with fumigating myself but again who’s going to take responsibility for all that’s damaged? Is that going to be put on me? What about my appliances? What about all the wood that was eaten? Is that on me? If I move I will be moving with them anyway so that’s of no use. Now we are going for a hearing.

I am utterly hurt, disappointed and ashamed that I’m a client of Pam Golding. It was my first time using them and I think this would be my last

Quick Update: So this response after mediation

Good afternoon,
Following the rental tribunal meeting via Microsoft Teams on 21/02/24.
The mediator suggested that we see if a compromise can be made with regards to the fumigation of the ****roaches.
We spoke to the pest control company and they sent through a revised quote that is a bit more inexpensive.
Please see attached quotation.
The suggestion is as follow:
The quotation is a total of R1190,25.
Pam Golding will pay R396,75, a third of the total as it would have been before occupation. The difference, R793,50 then paid by you, two thirds of the total as it has been two years after occupation.
The treatment consist of 2 visits to the property. The initial treatment and then 14 days after the initial treatment.
Should you accept this arrangement we will schedule an inspection with you before the treatment takes place and after the second treatment has been finalized.
Please let us know if this arrangement will suffice.

I proposed an offer: Good day

I hope this mail finds you well. Having considered your proposed offer to settle,
I wish to advise you that the offer is rejected.

In view of the fact that the tenant before me had the same problem and I also had requested that the place be fumigated before i moved in; and your representative confirmed and undertook to fumigate in a space of a week; you are solely liable for the cost of fumigation.

However in the spirit to amicably settle this matter I propose that i pay the R396,75 which is a third of the total, and you be liable for the difference.

You have further not considered the fact that my appliances have been damaged by the infestation of the coackroaches which you failed and or neglected to fumigate before i moved in. Also, there are damages caused by the ****roaches within the unit itself of which I cannot be liable for. I submit that such damage can also be attributed to your failure and or negligence.

Kindly consider this counter offer and revert soonest.

Their final offer: Good afternoon,
With regards to the above.
Thank you for the e-mail.
We have reviewed the content of your e-mail as well as the e-mail sent to the body corporate.
You mention that our representative undertook and confirmed that the unit will be fumigated. Please provide us with the necessary proof thereof.
In your e-mail to the body corporate you stated that you had to replace appliances several times due to the ****roaches however, we did not receive any communication regarding the infestation until December 2024.
I will attach the WhatsApp’s that we have received from you from the time of occupation until present. There is no mention to us of ****roaches in any of the WhatsApp’s nor of the appliances that you needed to replace.
Unfortunately Pam Golding will not accept the counter offer.

Quick update on my reply.

PROPOSED OFFER

Good day

Your previous email bears reference, wherein you request proof that there was an undertaking by your agent to fumigate. You further assert that there was never any communication between myself and yourselves regarding the infestation of ****roaches and the fact that it caused damage to my appliances.

Please be advised that Mr Francois Pottas, who was under your employee and acting as your duly appointed agent made a verbal undertaking to fumegate with 07 days of handing over the key. This was never reduced in writing however this gave a legitimate expectation on my part that your agency was to fumigate, having expressed my dissatisfaction regarding the ****roaches before i moved in and since the previous tenant also said that was his reason for moving out.

Further please be advised that i did not immidiately move in after being handed the key, as i still resided with my mother who was extremely ill at the time and needed my care and support. I only fully moved in once my mother had recovered and could care for herself a year and months after i was handed the key.

When i realised that the problem still persisted, I caused in to call Mr Francois Pottas on August 2022, another in November 2022 and an email to be sent, on the 27th November 2022, wherein I clearly indicated that the problem with the ****roach infestation still persisted, and that it was causing damage to some of my electrical appliances as i had to replace a microwave and a toaster at that time. This email correspondence was to ***, same is attached here for ease of reference.

Therefore the assertion that you only received communication in this regard only in December 2023 is unfounded and a deliberate attempt to avoid liability.

Kindly reconsider the proposed counter offer as I still wish to amicably resolve this matter.
