Under delivery on proposed and invoiced solution

So a few months ago, Oxbow gave me a proposal to replace my current machine with the exact same , but upgraded machine. I accepted as the were the supplier of the old machine and it was time for an upgrade.

First they could not get finance so I got my own finance. The amount was paid over to Oxbow in June 2018. Today, a month later I received an invoice from their "finance-partner" for rental. I was then informed that Oxbow never paid BEAF who is now keeping me liable for rental. A month after the money was paid over.

The worst however... The machine i received was all but the same, about EVERYTHING was down-scaled:

I had a PROFESSIONAL finisher - I now have a Office Finisher I had a top of the art punch - I now have a small one that cant handle the volume. I had a 2 staple units, 1 for single and a unit with 2 for double - I now have 1 unit to handle both types of stapling. I had capacity to hold 7-8 packs of paper - I now have capacity of 4 packs.

This from a company who knew exactly what I had, what my monthly volumes were/are. A company who offers 1 thing, deliver something sub standard and expect me to pay for the offered, but not delivered equipment. Sending technicians and expect that to fix the mess, a problem that can only be fixed with the CORRECT and PROPOSED equipment!

Worst is that I have send email on email without any ownership. Even the technicians confirmed that the equipment I received is not the same or suitable for my business.

My next step is to lay a complaint with the ombudsman and to consult with the consumer protector as Oxbow is not at all willing to sort out their under delivery!

So much for equipment worth R220 000 . At least the commission was good!

Dear Francois,

Apologies for the poor customer service experience.

This reply to confirm that the finance house had knowledge that the deal was moved over to ABSA yet still collected a rental which was out of our control.

I believe a good meeting took place earlier this week with our Account Manager and you are waiting on a solution to improve the productivity of the existing equipment.

Once resolved I would like to visit you, introduce myself and strengthen our partnership going forward. Again, apologies for the experience.

Hi Brett I also believe that the meeting we had to solve the technical problems was productive. Unfortunately, yet again Oxbow did NOT deliver! My meeting was on Monday 30 July 2018. During the meeting I was told that I will have a workable solution within 2 days. I gave grace and said as long as it is sorted within that week. Conclusion..... Meeting took place 2 weeks ago....30 July 2018 Today is the 13th of August 2018. Feedback.....ZERO....NOTHING.... This just proof the point I made originally, until the contract is signed, Oxbow is all over the client....The moment that part is done, delivery and customer service does not exist. I have a busy week, but as soon as I get an opportunity, I will request the ombudsman to look into the matter.

We were led to believe in our last meeting that we had more time to resolve this issue yet accept if you may have changed your mind.

In reply to your query:

We confirm that the quoted price and the order price you accepted are different as we offered you the more competitively priced entry level finisher versus the high end finisher as an alternative. You wished to reduce the purchase price and this was the option you decided to accept. We can send you confirmation of this should you require which clears supports our version of the offer.

If you feel that the high end finisher now suits your needs better we are happy to accommodate you at the additional expense quoted up front.

We are in your hands and happy to proceed with either finisher at the correct pricing quoted.

Kindly advise.

Good day Brett For the record, I did NOT change my mind with regards to the time you had to give feedback. I was told by Claud that I will have an answer in 2 days. I told him that as long as I had an answer by the end of the week (5 days). After 2 weeks I got NO feedback, but now you want to let it look as if I "changed my mind". SERIOUSLY? It seems that what is said/committed in meetings are totally different in reality. With regards to your response that you offered me a more competitively priced entry level finisher versus the high end finisher as an alternative. This is absolute BS. Claud and Jarred was in my office and I told them that I do NOT require the booklet creator, I never requested a downscale in all equipment. This is what happens when you trust the company you have been dealing for 5 years! You also NEVER quoted me on a cheaper price as you imply, I had to take this up with Jared as my invoice was for the full amount after installation. On the 17th of May I emailed him requesting my booklet creator (as I felt that due to the FACT that I was invoiced in full, it was my right to get the booklet creator. On 18 May I was emailed by Jared and I quote "you said you didn’t need to fold anymore and that was removed." So your sales rep confirmed that only the booklet creator was requested to be removed (Yet again, what was discussed in the meeting was confirmed here on email, but as per norm a different report is send to you). Yet the price was full. He then referred the costing matter to Claude. I was contacted via email on 21 May 2018 by Claude who said he will look into the costing. Then I was eventually given 10% discount. So I would really like to see the quote where you offered me an more competitively priced entry level finisher. Go have a look when the printer was installed VS the discount. Why will I downgrade my setup for +-R20 000? Why will I downgrade my setup and sit with printing that reflects badly to my brand? As I said before, the meeting was held and I said I do not need the booklet creator, and Jared confirmed this on email!! To be honest, I do not have the time and energy to spend on this anymore. 1 Thing is for certain, this machine is now my property, so my only dealing with Oxbow will be regarding the services. This will be the last business I do with Oxbow. Please email me a copy of the purchase contract as well as the service contract.
