One of your policy holders caused an accident with two other cars involved.
To give a summary of the accident on Sunday 9th February 2020 the policy holder (your client) was driving on the left on Hendrik Potgieter road and attempted to turn right on a solid line from there into Christian de Wet. Whereas if a turn like that needs to be made you need to be on the right lane which is the only turning lane. My husband was driving on the fast lane which is the lane next to the left. Your clients excuse was that “she had missed her turn”. As your client did an abrupt turn my husband had to try avoid hitting her by swerving the car. He did end up hitting her and then his car flew off to on coming and he hit the oncoming cars.
Police were on the scene and took the attached summary and there were plenty of witnesses on the scene as well.
We requested the police to take breathalyser tests on the scene as we could smell alcohol to which they did. Before they took tests your client revealed that she had been drinking earlier in the day however she had stopped before she was over the limit. The test proved that she was not over the limit. She took full responsibility on the day of the accident and said that she would put in the claim for my husband’s car as she was in the wrong to our surprise the following week.
We then heard from Outsurance that your policy holder claimed that my husband was driving fast and that’s why there was an accident. She failed to mention that she turned on a lane that prohibits her from turning and this is why the accident occurred.
For such a huge well-known brand I am utterly surprised by how Outsurance claims department handled the case.
1. We were told that the onus is on us to follow up on the case which I think is unfair considering all case documents were handed in. 2. Every time we would call the person handling the case the person would be unavailable. 3. We then received feedback from Outsurance of the exact opposite of what happened (Attached). When we asked what’s the appeal process we were told there wasn’t one. When we asked how they investigated we were informed that the clients word was taken an no other measures we taken. No witnesses were called. No footage was searched. No police report was looked at. 4. We were told again that the onus is on us to prove otherwise. 5. We looked for the police report and submitted it on the 4th March 2020 and we are still awaiting feedback.
