Waiting for excess fee

It's been three full years now since I've been waiting for Outsurance to pay me back the excess fee. I know the case is dragging due to court and what not but guys I've been very patient and I really need this money. Can't they just pay me from their account and they will take that one which they are still fighting for from the third party and again I don't get it why did they hold an excess fee because the car was written off, it was not going to be fixed for me. This is frustrating, yes I did receive an excellent service from you guys but the waiting man, is way too much.
