Unfair treatment

On Monday 24 April 2017 I was involved in a car accident. While I was driving on the fast lane the car infront of me stopped and hit hazards, I also stopped my car and hit hazards but the car behind me bumped me and I crached to the car infront of me. I went out of my car and the young lady who was driving the car that bumped me also came out and apologised for the accident.

It took a while before the traffic officer could get to the accident scene but eventually a police officer arrived and interviewed all parties involved. I then called my car insurance company (OUTSURANCE) to inform them about the accident that took place.

On Tuesday 25 April 2017 I phoned OUTSURANCE to make a follow up and also inform them that the person who bumped me was also an OUTSURANCE client, the gentleman then requested me to forward the details of that person by email. On Wednesday 26 April 2017 I received a phone call from the gentleman assisting me from outsurance to inform me that the car was written off.

On Friday 28 April 2017 I received a call from OUTSURANCE LEGAL and the gentleman informed me that the person who bumped me from behind is refusing to pay for damages because she says the accident was my fault, meaning I should claim from my own policy thereby totally absolving her.

I called the gentleman assisting me from OUTSURANCE to complained about the whole matter. He told me that there is nothing they could do as OUTSURANCE if the client is refusing to pay. I asked about the traffic department report and I was told traffic officers are not involved if both clients are with the same insurer (OUTSURANCE).

No representative from OUTSURANCE LEGAL called and asked for my side of the story, I was only called to be informed that I must claim from my own policy because the person who bumped my car was refusing to pay.

I feel outsurance did not treat me fairly as their client and a thorough investigation was not conducted. Their final word was only based on what the other person told them and my side of the story and road traffic laws were not considered, especially when the person bumps you from behind.

Hello Ntokozo28

Firstly, please accept our apology for the belated response.

Our internal liability claims manager did investigate the matter further and we have no alternative than to proceed with the claim on your policy, as the other party refuses to take responsibility.

Warren did contact you and provide you with detailed feedback.

We are very sorry about the disappointing outcome, but endeavour finalising your claim as soon as possible.

Regards

Dinky
