UNFAIR CLAIM REJECTION BY OUTSURANCE – NO EVIDENCE, NO REPORT, AND MISREPRESENTATION ALLEGATIONS
I am extremely disappointed with how OUTsurance has handled my claim (Claim No: ***) especially after being a loyal client for over 11 (Eleven) years with multiple insured assets. My claim was rejected on the basis of alleged “misrepresentation of the regular driver,” which is both incorrect and unsupported by proper evidence. At the inception of the policy, I clearly disclosed that the vehicle would be driven by three individuals namely myself, my wife, and my son. However, the consultant insisted that only one regular driver be recorded, and I was forced to nominate one person. This was not a misrepresentation but compliance with OUTsurance’s own process. Despite this, OUTsurance later rejected the claim using information gathered long after the policy started, trying to reinterpret the original disclosure. What is most concerning is the following: 1. OUTsurance has failed to provide the policy inception call recording, which is the most important piece of evidence to verify what was disclosed 2. They have failed to provide any formal assessor’s report, and I was informed that no such report exists, with the decision being based on “balance of probabilities” 3. Their conclusions rely on informal statements from third parties (friends and security guards) who had limited interaction and cannot reliably determine who the regular driver was 4. They ignored factual explanations about how the vehicle was used within my household Even more troubling is that their own response letter states that the matter is “time barred,” yet they only meaningfully engaged after multiple follow ups and escalation from my side. It is unreasonable for an insurer to delay responding, fail to provide requested documentation, and then rely on time bar provisions. I also find their position on returning premiums illogical. I am not asking for cancellation,I am asking for my valid claim to be honoured. I am even willing to accept a reasonable premium adjustment if necessary, but outright rejection is unjustified. This entire process feels like an attempt to avoid paying a legitimate claim rather than a fair and objective assessment. As it stands: 1. There is no proof of misrepresentation 2. There is no documented assessment report 3. There is no transparency in the decision making process I am now left with no choice but to escalate this matter further through the Ombudsman and other formal channels. I urge OUTsurance to: 1. Provide the inception recording 2. Provide the full basis of their decision 3. Reconsider and settle the claim fairly
