Unfair claim handling and client changing statement after agreeing at police station

I am extremely disappointed and frustrated with how my accident claim is being handled involving a client insured by Outsurance

The accident occurred on 14 April. I was turning right from a stop sign after being given the right of way by traffic. Your insured client overtook multiple vehicles from behind, drove into the oncoming lane, and collided with my vehicle.

After the accident, we both went to the police station where we carefully discussed and agreed on the same version of events. Your client personally wrote the incident report, and we both confirmed that it was accurate and true.

However, I am now shocked to find that when your client submitted her claim, she changed her statement and is now presenting a completely different version of events.

Despite me submitting: - The official incident report (written and agreed to by both parties), - Supporting evidence of how the accident occurred,

There is, in fact, a barrier line present at the scene. * Your client was overtaking traffic ********ly and driving in the oncoming lane. * I have already provided the incident report, which supports my version of events. * Despite this, it appears no effort has been made by your team to verify the road markings or revisit the police report.

Outsurance is still relying on their client’s new, inconsistent statement instead of the agreed police report.

I have also been told that the investigation will take 4 to 6 weeks, which is extremely frustrating considering that the key evidence already exists and clearly shows a contradiction in your client’s statements.

This situation is unfair because: - The facts were agreed upon at the police station, - The report was not disputed at the time, - Your client has changed her version after the fact, - I am now being prejudiced by delays and a process that appears biased.

As a result, I am being forced to use my own insurance and pay an excess of approximately R8,000, even though I am not at fault.

I expect Outsurance to: - Properly consider the original incident report as primary evidence, - Address the inconsistency in your client’s statements, - Take accountability and resolve this matter fairly and urgently.

If this matter is not resolved fairly and within a reasonable timeframe, I will have no choice but to escalate the complaint to the Ombudsman for Short-Term Insurance and pursue further action.

I would appreciate immediate attention and a fair resolution.

After responding privately to you, we escalated the matter to our legal manager, Jonathan.  Every claim is dealt with on its own merits. We base our decision on case law and information at our disposal. Jonathan has reviewed the matter and provided you with feedback.
