Unfair and unjust

A reckless and negligent driver that is insured with Outsurance crashed into my car at corner Jan smuts and Empire road on the 21 May 2021. On the scene he apologized and admitted to his mistake and asked me to submit a claim with his insurer. Outsurance responded to my claim and said there’s conflicting versions of events between me and their client. I requested that Outsurance should uplift the footage from the cctv to prove my version of events but they refused and told me they cannot do that on my behalf which is really unfair because as an individual I cannot uplift the footage as it is in contravention with the POPIA act. I have also submitted a sworn affidavit from the witness but whenever I ask the progress of my claim they tell me that my matter has been escalated to the senior manager and they never come back to me with a response.

I use my vehicle to generate income. I am left helpless and do not know what to do next.
