Third Party Claim - Unfair Settlement Offer Being Offered
Hi
I just wanted to express my disgust in the way Outsurance has handled my third party claim after there client skipped a red robot and knocked into my daughter who was driving my vehicle at the time.
About 4 months ago (16 May 2024) their client skipped a red light at an intersection and collided into my vehicle hitting my vehicle on the left side. I have video footage of the incident. I subsequently submitted my claim the first time & was rejected based on the report submitted by their client stating that the robot was orange when he crossed. I then sent the video evidence, they then came back confirming that the vehicle that collided into me was 100% wrong and admitted that he skipped the red robot, but assumed I was their client and that the person that knocked into me was the 3rd party. After correcting them on this issue they came back with with a settlement offer, saying my vehicle was not economical to repair (No assessor ever came to see to the vehicle) and app**** 50% amount for salvage (No salvage company came to inspect the vehicle & confirm their offer) and furthermore offered a settlement based on the 70/30 % liability clause. 70% app**** to my vehicle and 30% to their clients vehicle, even though I have evidence to the contrary.
I asked them how can they assume that the salvage company will pay me the amount and also how can assume that the vehicle is not cost effective to repair without anyone inspecting the vehicle. They refuse to listen to anything I have to say, and said I can whatever I want as that was their final offer.
I have decided to take legal advise on the matter since I am not getting any joy in regards to this from them.
