THIRD PARTY CLAIM REJECTED
I would like to express my disgust in the way Outsurance has handled my third party claim. On the 17th January 2019 I was driving to work, when approaching an intersection- Which was Green for me to go across a Client of Outsurance hit into my car on my side of the vehicle,my car then hit into another vehicle, After the impact I checked the robot it was still green for me regardless. I was then rushed to hospital to discover after running various tests, I had 4 broken ribs. I was fortunate to see the other driver’s affidavit, in the affidavit he reported that he was jammed, got stuck in traffic and saw a gape and took it, keeping in mind the robot was red for him. Since the accident it was numerous visits to the doc, police station, municipality office- where I was able to retrieve the footage of the accident. I lodged a third party claim and submitted all the documentation Outsurance needed. After a few weeks, the agent who was assigned to the claim, Mr Joe Skosana informed me that the claim was rejected and documentation/ letter was sent to me with numerous reasons for non-payment -Our Insured entered the intersection due to heavy traffic within the intersection he could not clear the way and the robot turned red while he was there -He slowly proceeded to clear the intersection -Our insured managed to clear the lanes when I approached the intersection without reducing speed or without caution as required by the rules of the road -Our insured was not the negligent party as he was denied right of way- EVEN THOUGH THE ROBOT WAS GREEN FO ME? Ridiculous outcome!
This statement given above by their client was totally false, Outsurance has not taken into account the rules of the South African Roads. Looking at the footage the robot did not turn green whilst their client was crossing over it was Always Red- He basically jumped a red robot…. And I was meant to slow down even though it was Green for Me? Seriously? With all the witnesses/ authorities which viewed the footage showing that your client was in the wrong, forcing through a red robot, my claim was rejected My eyes have truly opened up as to how dishonest people can be and just lie with a straight face, and how Outsurance backs their lying clients up and quote particular clauses to protect their lying clients and do anything not to pay out people like me who were not at fault in any way. Watching the Outsurance Ads is a real Joke. Outsurance does not like to pay Third Party Claims and look for any excuse not to pay.

MVA CLAIM-COLLISION: 17 JANUARY 2019

With regards to the above-mentioned matter. Outsurance has re-opened the case once they have acknowledged our review on HelloPeter. They have reviewed the claim- To our surprise, they have reviewed the matter and came to a decision "We wish to advise that we have reviewed the matter and came to a decision that the matter is going to be apportionable. We are of the opinion that both parties have contributed towards the accident but with different percentages. We are therefore going to apply an apportionment of 70/30 in your favor in an attempt to settle the matter amicably. The settlement amount will be R5 469.57. "
This decision clearly shows that we are liable for their client's damages as well as ours. Big Surprise. We have received feedback from our lawyer. A Sheriff of the court has called, emailed and visited the premises of the Defendant numerous times and was not able to get in contact with him.
We have also sent Outsurance a summons which we received from the lawyer on the 26 Aug 2019, They have received it however they have not responded to say they have received the email. Not Surprised.
We will, however, continue by all means to take this matter further.

The lack of feedback as you described is concerning. We have escalated the matter to a legal manager who will revert with feedback.
