Third Party Claim rejected

Hi

I just wanted to express my disgust in the way Outsurance has handled my third party claim. About 2 months ago their client s****ped my vendor, headlight and bumper whilst trying to swerve to park her car infront of mine(which was stationary). Her attitude was like it was my fault that she misjudged her move , almost like i was to blame for her blunder. In the affidavit she reported that she gave way for a car that wanted to also past from opposite side. At that point she admitted guilt together with the police officer helping us on the day. I then lodged a third party claim and submitted all the documentation Outsurance needed. After a month i called Outsurance as nobody got back to me, the agent who was assigned to the claim informed me that the claim was rejected and documentation was sent to me , which i never received via email. I asked for reason and below is the what they told me.

"Good day We refer to the approach you have submitted against our client for damages arising from an accident that took place on the 24th of November 2017. Our client advised that she travelled on a through road in her lane, when another vehicle suddenly came into our client’s lane, posing a danger. Therefore, our client had to act reasonable and swerved to avoid the oncoming vehicle. The law describes sudden emergency as a situation where someone was faced with an unexpected danger. The law requires such a person to act reasonable in avoiding such a danger. We therefore deny liability herein and close our file."

This statement given above by their client was totally false, their client all of a sudden changes her story to her insurance and claims that the oncoming car suddenly appeared and was unexpected. This obviously is a lie, when i told them that this was not the case they insisted that i get a independent witness to prove my case.

Really? I honestly didn't think that i needed a witness to vouch for a simple parking blunder by an *********** driver. About 2 years ago another lady also knocked my car with her door and there was no problem with the 3rd party claim which went via Santam Insurance, within a week the money was paid into my account.

My eyes have truly opened up as to how dishonest people can be and just lie with a straight face , and how Outsurance backs their lying clients up and quote particular clauses to protect their lying clients and do anything not to pay out people like me who were not at fault in any way.

Hi Dinky i was contacted in the beginning of last week by one of your Outsurance agents , she then told me she would contact me back by Friday past. Still heard nothing from them.

Hi every body reading this review. So Outsurance came back with a response to my predicament. According to the advisor from Outsurance they listened to the story on events that happened that day again, and because she never deviated from her initial story they deem it as being the truth , even though this was not what was declared in the accident report. When i asked if this is in line with what's in the accident report the advisor rep**** saying that they only listen to the clients version and that the accident report doesn't really matter in this instance. Also , now all of a sudden their client has a witness as well, one of her children who was in the car , a minor by the way , who can vouch for her. When i initially advised that i have a witness to prove my case , Outsurance told me that it needs to be an "independent" witness, not family or close friend. So what app**** to me does not apply to their client in this regard? So i guess i have no case then , my word against their clients....... I would like to warn anybody planning on submitting a third party claim to Outsurance...they do not pay!!!! They protect their clients even though they are at fault. I had to repair my car out of my own pocket for something that was not even my fault!
