I was involved in an accident with an Outsurance client, whereby the client was at a stop sign and i was in right of way, she had intially stopped and waited for the car in front of me to pass and as i was approaching she went in, i hooted and app**** my breaks but she continued and thus caused me to bump into the back of her car. I have claimed from Outsurance, they requested that i send pictures of the damaged vehicle which i have and now the assessors claim that my car had previous damages and they got me a quote without even going to view and assess the car physically, they claim that i was 40% negligent and thus i need to pay for the damages 40%. What i don't understand is, how was i negligent if their client decided to stop and go in when i was already coming? and how did they come to the 40/60 ratio? what was i to do - the client has admitted to the fault and assured me that her insurance will pay for my car damages and now Outsurance is doing everything in their power not to pay for my damages. I don't have insurance, its been a month now that i haven't had a car - the transport cost and the installment is killing me financially
