THEY always get something OUT!!!

A client of OUTSURANCE drove into the back of of my car on 6 JANUARY and reported it to OUTSURANCE on 7 Jan. It is now almost 7 APRIL, THREE MONTHS later and OUTSURANCE is STILL giving me the run around expecting me to accept a THIRTEEN THOUSAND RAND offer on a car that was TWO weeks old at the time of the incident and which an actual live investigation showed a FOURTY THOUSAND RAND damage. They then told Me on 12 March that THEIR panel Beaters/assessors would contact me to make an appointment to do a live assessment on my car:STILL WAITING. **** POOR SERVICE and they are clearly trying to dupe yet ANOTHER unsuspecting INNOCENT third party into accepting a lesser amount for damages so that THEY can save money!NO!

Hello lhateavon

Thank you for approaching us about the outcome of your 3rd party claim.

Our liability claims manager, Nompu communicated our stance vir email after having received your complaint.
We advised you that when you institute a third party claim against our client and / or any other party whom you might feel is liable to reimburse for the damage of their property, the Law will play a major role, and this is not what Outsurance want or requires. This is one of the instances where in terms of South African, more specifically the Law of Delict, to Outsurance you are the plaintiff. When claiming against a client the matter is referred to as a Civil claim and therefore Law of Delict and Law of Collision will play a part. In liability claims we apply the South African Law as a guidance even if the matter has not been referred to a court of Law hence we did not pay the other party’s claim. We further advised that the assessment will be the same in terms of damages and/ or the difference will be on the amounts. Please note that we do not repair and /or pay the panel beater but pay the owner of the vehicle. You can take the vehicle for repairs to the panel beater specified by us. You need to present them with the attached quotation and if the panel beater detects any additional damages, we will refer the matter to our assessor to update the quotation and we will then amend our offer to match the amount of repairs.  On the 27/02/2019 we advised that you can take your vehicle to our assessment centre and offered to book same for you. You refused this and advised that we can only call you only if we are paying an amount of R40 000.00 as quoted by your panelbeater and then dropped the call. Please note that based on the above our offer still stands and we can only update once our assessor has seen the vehicle.

Regards
OUTsurance
