Repudiation of Accident Claim

My hubby got involved in a car accident on the morning of 20 Dec 2014. The insurer repudiated the claim, stating that he was driving under the influence of alcohol, after finding out that he was out drinking the previous night. Its interesting that this was based on the bill not blood tests which is the only conclusive proof. What ****ed me off is that after cancelling the cover, he got a call from them requesting him to reconsider staying on given that we have a good record and have been good clients? They even offered a lower premium if we didn't cancel? The nerve? All that these people care about is making money out of us. We are legally challenging the outcome and want our R252 000 spent on repair costs. It will be interesting to hear their argument because it is only through a blood test that the amount of alcohol can be determined. I read something on Noseweek 72 \\Outsurance boasts in all its advertising: \You always get something out\\\"\". In reality it's more like: sometimes you eventually get something out (and not if we can help it).\\\"\" Seems all they care about is the monthly premium but will do anything not to pay claims out. This is going to be an interesting court battle. \"\"\""
