Rejected Claim

On the 24 of January 2018 while at an intersection of Berry Hertzhog and The Brains, Emmarentia i was bumped from behind by an OUTSURANCE client. A police case was opened , she admitted she was wrong, i have the case number. She reported to her Insurance company (OUTSURANCE ) and we were given the claim number. I called OUTSURANCE and they sent me a claim form which i filled and submitted together with accompanying documents (pictures of the vehicle, quotations from different panel beaters, etc)

However prior to submitting the form i got an email from some lady MIA DU PREEZ (from OUTSURANCE LEGAL I believe) titled "WITHOUT PREJUDICE " asking me to contact her so we could discuss the outcome.I thought she was prompting me to submit the documents ofwhich i did.She sent me another email requesting my contact numbers ofwhich i did. She called me and told me that OUTSURANCE would not compensate me as the accident was caused by circumstances beyond their client's control unless i could prove otherwise.She said their client told them the road was oily and see did all she could to stop the car to no avail.(Mind you itwas a wet day as it was drizzling)

I asked the Ombudsman for assistance they told me they don't assist with THIRD PARTY CLAIMS I tried small claims court, they told me my claim is way beyond their limit (R15 000) Last month i tried Wits Law Clinic, i was told the students are writing i need to come back on March 2019 I tried Pro Bono Org at Constitution Hill they told me they cannot assist me i need to go to high court. I feel like I've reached bottom rock. Its almost a year now and i always have a problem with the police . Please assist
