recovery of excess from 3rd party inusrance compan

I have had two claims where i have had to suffer the loss , due to non recovery from outsurance, <br> i feel that they should try harder , and fight for the customer ,<br> both cases we were the victims of other people riding into us, <br> and the evidence is clear as day<br> they say that the passanger in the truck cannot be a witness ???<br> he was there and saw what happened,,,no cars stopped helllooo busy circle, ?????? so how do you get a independant witness .<br> photos show the impact <br> drivers statement issued at the accident scene differs from the one he gave on the 30th august, ,,,accident took palce 18th of May,YET this is not taken into consideration.<br> i have to take the loss again , i find it not acceptable .<br>
