RE: Outsurance claim no *** writing off Nissan NP300

My first question to Outsurance, what is the purpose of having insurance? My answer to that is, is to place your client in the position that they were in previously, which is not the case in this instance, and that is having a vehicle on the road without having the client to buy a new vehicle and incurring extra costs. The accident was caused by one of Outsurance's contractors. To be specific: 1 First Road. We received a report whereby outsurance wants to write of our Vehicle which is a Nissan NP300 with 66000 km on the clock that is still financed by the bank. The settlement on the said vehicle at the bank is R85 000.00, outsurance's retail value is R106 000.00 which leaves us with a R22 000.00 payout from them, which is putting us in a worst position that we were before the accident. I then requested the contact person Shahid Koeries, the agent working at Outsurance if it is possible if we can purchase the vehicle from them. He first said to me once the bank is settled the vehicle belongs to the bank, which I found rather strange as the vehicle does not belong to the bank any longer. Then this morning in a telephonic conversation with him, he admitted that the vehicle will belong to Outsurance once the bank is settled. I then asked him, if we could buy back the said vehicle and what will be the reserved price, which he said he cannot provide me with. My question again why not, as the vehicle belongs to outsurance? If they use a salvage contractor why can they not get the reserved price, seeing that I am the client as part of outsurance service to us. I am under the impression that we can have the said vehicle repaired without the vehicle being written off. I see ourselves as valued clients of Outsurance, and that they should look after our interests at all times, which is not the case. Clearly they are not assisting us at all, because they will be the only party that will benefit in this situation by writing off the vehicle and to recover their costs in this case, whereby we are the losing party in the said matter caused by their service provider 1 First Road towing. I also requested a second quote from outsurance a week ago which I am yet to receive. In the meantime I got another panel beater to give me a quote which amounted to R60000? The bottom line is, we want to be re-instated back in the position that we were in before the accident, and what action outsurance is going to take against their service provider 1 First Road towing services?
