passing the buck

<p>I was involved in an accident with a person insured by Outsurance and he immediately admitted guilt. The accident happened on the 29th of June 2017. As I was approaching the robots, I noticed the robots were green, so I just carried on driving since I had right of way. As soon as entered the intersection , the insured's vehicle drove straight into my path. I app**** the brakes but it was already too late and my vehicle crashed into the insured's vehicle. He was supposed to wait for the green right turn arrow, but he saw the robots were green and decided to make a right turn. Im currently attempting to claim as a third party. After weeks of waiting, the insurance came back to me with an offer of R14 620, whereas my vehicle was worth R60 700. They stated that I was negligent for not observing the oncoming vehicle executing a right-hand turn in front of me and subsequently not taking any evasive action. They maintained that keeping a proper lookout means more than looking straight ahead – it includes awareness of what is happening in one’s immediate vicinity. A motorist should have a view of the whole road from side to side. They also said the fact that a driver may have right of way, does not absolve him from his duty to be vigilant. Once an approaching driver has begun to execute a right-hand turn, then a definite duty would rest on the through street driver to watch carefully and to take all such steps as may be necessary to avoid a collision. Therefore as a result they decided to settle this matter on a 60/40% apportionment in my favour, meaning they will only pay me 60 percent of the value of the car minus the 42 percent Less Salvage, which results in an offensive offer of R14 600.</p>
