Outsurance unfair and unjust dealings
On the 4th of October 2018 I was in a car accident with a client of Outsurance. I was driving a 2006 Toyota Tazz 130i and she was in a 2018 Hyundai i10 Grand. I was driving down Baden Powell drive towards Macassar and their client was approaching Baden Powell drive from a side road (Eisleben drive). Instead of their client stopping at the stop street on Eisleben drive and waiting to see if there are any cars driving in both directions on Baden Powell, their client decided to drive over onto Baden Powell drive towards Muizenberg. As she took the turn to the right, she realised that I was approaching and she stood still in the middle of the road. She could not turn as there was a car on my opposite lane driving towards her and there was a car behind her waiting at the stop street. It was at this time where I app**** dead brakes and braced myself for impact. By the time I had seen her it was too late, so I still collided with her vehicle on the driver’s side door and fender. My first instinct was to jump out of my vehicle and make sure she was okay, which she was. I logged a third party complaint with her insurance (OUTSURANCE) and towed my vehicle to an assessment centre for inspection. A few days later I got a call from the assessment centre and I nearly cried, my vehicle was declared not fit to be fixed. So basically they wrote it off. I then removed the car from the assessment centre (which costed me R8000 out of pocket) and took it to another mechanic/panel beater for a second quote. This quote too came back more costly to fix than what the car is worth. I then passed on all this information to them as per their third party process. For a whole month every 2nd or 3rd day I have been emailing and calling the legal advisor who my case was assigned to. In some instances I had to follow up on my own emails sent as I had not received responses for days. Almost every time I called the legal advisor to follow up on my case, I would reach their call centre. Every single time I had to leave my claim number and cell phone number so that they could leave the legal advisor a message to call me back. There were days where I called more than 4 times and still would not receive a call or email back. THIS HERE IS BAD SERVICE. What angers me the most is TODAY 11th November 2018 I finally got feedback on my claim and to my surprise I was left with an utter disgust with what the legal advisor said. So according to Outsurance, because my vehicle was not rear ended, I would not be paid out 100% of my claim. He then said that the next thing is to determine the merit of the accident and apportionment would then apply. At this stage I was already furious as I kind of knew where they are heading with this. He then says the apportionment is 40/60. So I was 40% in the wrong for driving straight in a lane where I had right of way and she was 60% in the wrong for not only failing to adhere to the rules of the road(stop street) but also to put other drivers lives in danger by driving so recklessly. SERIOUSLY!!! This is disgusting that they think it is okay for them to give such a “settlement offer” as ridiculous as that. Not only that, because I was 40% in the wrong I need to pay for 40% of her damages. SERIOSULY!!! After doing their “calculations” apparently I owed them money. SERIOSULY!!! Now for the final nail in the coffin, their settlement offer is, “let’s call it even”. They pay me nothing, I pay them nothing and we just go our separate ways. How unfair and unjust is this. Just because they are a corporate with a full legal team and I am just an average Joe, they think it is fair and reasonable to expect me to walk away from this. I seriously hope this is not the same with their own clients and even all their third party claims. I would not insure anything with outsurance nor would I recommend outsurance to a single soul out there. The way they have serviced my claim and with the settlement offer they gave, their business dealings need to be looked into immediately. As per their slogan, “You always get something out”. Which in my case, this is not true.
