Outsurance turned claim around on INNOCENT

<p>Incident occured on 11th July</p> <p>Their client hit the mirror and rim on my car. </p> <p>Incident occurred on 11th July. Their client hit my mirror and rim. BOTH agreed i will do a 3rd party claim.</p> <p>Sent mails to outsurance. Came back with a rejection letter. That I hit their clients vehicle. How did this happen that the situation was reversed i don't know. This could even be ***** to some extent.</p> <p>Mail below sent in response to rejection letter. With a recording that the client admitted negligence....havent heard a response since. </p> <p>Good day</p> <p> </p> <p>Kindly note I will be taking the matter legally to the insurance ombudsman and Small Claims Court.</p> <p> </p> <p>I do not agree to the rejection letter as Your Client and myself had a conversation on the 12/07/2017 attached with call log.</p> <p>Your client knew that I was going to do a 3rd party claim on her insurance ..OUTSURANCE.</p> <p>The conversation was recorded to avoid any misunderstanding or denial.</p> <p> </p> <p>The conversation clearly depicts your clients negligence as she said “It was dark and the car was dark in colour, she did not see the vehicle, she had heard the hooter she had gone to close to the barrier line. There is none mentioned of my vehicle hitting her vehicle as stated in the Rejection Letter.</p> <p>As per my incident report made at The SAPS, under oath.</p> <p>Your client crossed the barrier line, as also stated on the call.</p> <p>There is no conversation that was made with your client, OUTSURANCE or my insurance to state that I admitted or was any fault.</p> <p> </p> <p>This questions the legitimacy of the rejection letter quoted, “the driver of your vehicle took the turn too wide and collided</p> <p>into our insured’s vehicle”</p> <p>Apart from the call, the pure logic of the driver hitting your clients vehicle is literally nonsensical, it’s a bending road to the left ,the driver would turn left and bend to the left closer to the pavement.</p> <p> </p> <p>I understand that all insurance will advise that client, rule no.1 do not admit fault, but what about principal.</p> <p>A response is needed to take this to my legal personnel and Claims Court</p> <p>No response since. I need a response in receipt of that MAIL.</p>
