outsurance says they won't pay 3rd party cz it was an accident

on the 7th of September 2016 a lady insured by outsurance bumped into my car and acknowledged fault saying she had been to the gym the previous day and had a muscle spasm and couldn't stop the car hence she drove into my car. She called Outsurance while I was with her and told them this and I also spoke to them and they sent me claims forms. on the 5th of October outsurance came back stating that they will not pay for my claim because their client had no control over her muscle spasm. I told them that if she had control over what happened it wouldn't have been an accident ,it would have been negligence so why are they not paying for this one as it is an accident. We called their legal department and spoke to Nas Senne who handed us to Jeanine who said we need to prove that has client did not have a muscle spasm and she is protecting her client. These are the same people that have been calling me to quote me for car insurance. And that day they are protecting their client by not paying my claim . Ultimately their client bumped into my car and my car is damaged and needs to be fixed so if they won't pay thateans I need to go via the legal route and claim from their client who then needs to find R14200 somewhere to pay for my car ,talk about protecting their clients yet leaving them to face legal battles while paying monthly premiums which do cover 3rd party claim.

I am shocked at the lack of customer care from outsurance and the shallowness to think a customer is only their client and not see me ,my family and friends as potential business. and I'd hate to find myself in their clients shoes where I have to make a plan to pay for an accident while paying for comphrehensive cover.

Outsurance refuses to review their decision and say that will protect their client ,I says they are protecting their money which their clients pay then monthly to be covered

We are so sorry about the disappointing outcome of the 3rd party claim and thank you for the opportunity to look into the detail.

Our liability claims manager, Chrisna, contacted you and discussed our revised decision on the claim as well as the reason for the initial decision to refute liability.

We are pleased to know you are satisfied with the outcome.

Regards
